Setting Up a Trusts for Medicaid Planning Purposes
Recently my clients have been asking, can we set up a Trust to avoid Mom and Dad’s Estate from being acquired by the State because of lack of Long Term Care planning?

The Problem in transferring asses is that you have given them away and generally you longer control them, even if a trusted family member may lose them.
A Trust is a legal entity, which you can name yourself or other to be the Trustees. A Trust is designed to hold property for the benefit of others or Beneficiaries.
The Trust must follow rules that have been set in place. the assets in a trust may or may not be counted towards eligibility of Medicaid.
A Revocable Trust can be changed or rescinded, a revocable trust would not be a good fit for Medicaid Planning.
An Irrevocable Trust can not be changed at all after it is established. This type can be set up so that income is paid to you at a set limit and cannot be changed. For planning purposes, the principal balance can not be count towards your income limit or counted as an asset for Medicaid.
